These Terms of Service (“Terms”) are a legal agreement between you and Fireside Heating & Air Co., and they cover your use of this website and any service request you submit through it. By browsing the site, filling out a request form, or calling a number you found here, you are agreeing to these Terms. If you do not agree, please do not use the site.
Important notice: these Terms include a binding arbitration agreement and a class-action waiver. Those provisions are in Section 9 below. They affect your legal rights in a meaningful way - please read that section carefully.
1. The Businesses That Do the Work - and Our Limits
Every piece of home-service work requested through firesideheatingair.com is performed by an independent contractor business - not by Fireside Heating & Air Co.. Those businesses are entirely independent. They are not our employees, agents, legal partners, joint venturers, or representatives, and we have no authority to direct, supervise, or control the way they do their work.
Because we do not perform the work and do not control the people who do, we are not responsible or liable for:
- the quality, safety, or timeliness of any work performed;
- any pricing a business quotes or charges;
- whether a business holds the required licenses, permits, or insurance;
- the conduct or competence of a business’s employees or subcontractors;
- any act, omission, negligence, property damage, personal injury, or other loss caused by a referred business.
When you decide to hire a business, your service agreement is with that business - Fireside Heating & Air Co. is not a party to it. Passing your request to a business is not an endorsement, certification, or guarantee of any kind. Before authorizing work, we strongly encourage you to verify the business’s licensing and insurance status and to read any written contract they provide. If something goes wrong with the work, that dispute is between you and the business that performed it.
2. Calls and Text Messages (SMS Disclosure)
When you submit a service request through firesideheatingair.com or by phone, you are providing your express written consent to be contacted. Here is what that means:
- Who may contact you: both Fireside Heating & Air Co. and the independent business or professional that receives and handles your request may reach out to you.
- How we may contact you: that contact may include calls and text messages placed using an automatic telephone dialing system (autodialer) and messages delivered with a prerecorded or artificial voice.
- Consent is not a purchase condition: agreeing to receive these calls or texts is not required to buy any goods or services. You can request service without providing this consent.
- Message frequency: how often you hear from us depends on the nature of your request and how the servicing business responds - frequency varies.
- Carrier rates: message and data rates may apply depending on your mobile carrier and plan.
- How to stop messages: reply STOP to any text message to stop receiving texts. Reply HELP for assistance. Please be aware that opting out of text messages does not automatically end all contact about an open service request - if you want all outreach to stop, let us know through our contact page.

3. Who Can Use This Site
To use firesideheatingair.com or submit a service request, you must be at least 18 years old and legally capable of entering a binding contract under applicable law. You also represent that you have the authority to authorize work at the property address you provide - meaning you own it, manage it, or otherwise have the right to request services there. If any of those things are not true for you, please do not submit a request through this site.
4. What Fireside Heating & Air Co. Actually Does
Fireside Heating & Air Co. is a marketing and referral company. We operate firesideheatingair.com to advertise home services and connect homeowners with local professionals serving Lancaster, PA and surrounding areas. When you fill out a request form or call us, we collect your information and pass it to an independent service business in our referral network.
Every estimate, repair, installation, and service call - every piece of the actual work - is carried out by those affiliated service providers and the licensed tradespeople they employ. Fireside Heating & Air Co. does not perform home-service work. We do not employ field technicians or tradespeople, and we do not direct or supervise how any job is done. The business that accepts your request sets its own schedule, prices, and materials and defines the scope of the job. Availability of any particular business for any particular job is not guaranteed.
5. Your Responsibility to Us
You agree to indemnify, defend, and hold harmless Fireside Heating & Air Co., its owners, officers, employees, and affiliates, as well as the independent businesses in our referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and reasonable attorneys’ fees that arise out of or relate to:
- your use of firesideheatingair.com or any content you view, submit, or rely on through it;
- the information you submit to us, including any inaccuracies in that information and your authority to provide the phone number or contact details you give us;
- your breach of these Terms or any applicable law or regulation;
- any act or omission on your part in connection with a business we refer you to, including any dispute or transaction between you and that business.
This obligation to indemnify and hold us harmless survives after you stop using the site or after these Terms otherwise end between us.
6. Limits on Fireside Heating & Air Co.’s Liability
firesideheatingair.com and the referral service it provides are offered “as is” and “as available.” We make no warranty that a business will be available for your request, that anyone will contact you within any particular timeframe, or that any specific outcome will result from your request.
To the fullest extent permitted by law, Fireside Heating & Air Co. is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages - including lost profits, lost data, or damage to your property - arising from your use of this site or our referral service.
If Fireside Heating & Air Co. is found liable to you for any claim related to this website or our referral service, our total liability to you is capped at one hundred dollars ($100.00) or the amount you actually paid to Fireside Heating & Air Co. (which is ordinarily nothing), whichever is greater.
This cap applies only to Fireside Heating & Air Co.’s own conduct in operating this website and passing your request along. It says nothing about the liability of the independent business that performs your work - responsibility for the quality, safety, and outcome of the work sits entirely with that business, not with us.
7. Governing Law and Venue
These Terms are governed by the laws of the State of PA, without regard to its conflict-of-law rules. Subject to the arbitration agreement in Section 9, any court proceeding that is permitted under these Terms must be brought exclusively in the state or federal courts located in PA, and you consent to personal jurisdiction in those courts.
8. Resolving Disputes - Please Read Carefully
Step one - talk to us first. If you have a problem with Fireside Heating & Air Co. or this website, please reach out through https://firesideheatingair.com/contact-us/ before starting any formal proceeding. We ask for a reasonable chance to work things out informally.
Binding arbitration. If we cannot resolve a dispute informally, you and Fireside Heating & Air Co. agree that the dispute will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as they exist at the time the claim is filed. You are giving up the right to sue Fireside Heating & Air Co. in court, and Fireside Heating & Air Co. is giving up the same right against you, except as noted below.
Class action waiver. All claims must be brought in an individual capacity only. You and Fireside Heating & Air Co. each waive the right to participate in any class action, collective action, or consolidated action, and waive any class or representative arbitration. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class proceeding. This class action waiver is a material part of this agreement.
Jury waiver. To the extent any matter is resolved in court rather than arbitration, both you and Fireside Heating & Air Co. waive any right to a trial by jury.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice within 30 days of the date you first accept these Terms. Send that notice through https://firesideheatingair.com/contact-us/. Opting out of arbitration does not affect any other part of these Terms.
Small claims and injunctive relief. Either side may bring an individual claim in small claims court if it qualifies. Either side may also seek injunctive or other equitable relief in court to address misuse of this site or infringement of intellectual property rights.
9. No Warranty on Work - What We Can Do If You Are Unhappy
Because Fireside Heating & Air Co. performs no home-service work, we give no warranty or guarantee - express or implied - on any workmanship, parts, or materials. Any warranty on the job itself comes from the independent business that performed it, and any parts warranty comes from the manufacturer on the manufacturer’s own terms. Before work begins, ask the performing business to give you its warranty terms in writing.
If you are not satisfied with the work, the only thing Fireside Heating & Air Co. can do is act as a go-between: we will contact the business that serviced your property and request that they return to address your concern. That is a courtesy coordination effort on our part - it is not a guarantee that the business will respond, that the issue will be fixed, or that any particular outcome will follow. Fireside Heating & Air Co. will never perform, redo, or repair any work itself.
We will not promise refunds of money you paid to the performing business - that is a matter between you and them.
